By accessing or using Elyva ("the Service"), operated at elyva.ai, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service. Elyva is operated by Elyva Inc. ("we," "us," "our"). These terms apply to all users of the Service.
Elyva is an AI-powered personalized behavioral coaching service designed to help users understand and transform the patterns that affect their weight and health. The Service provides a diagnostic intake, personalized intervention sequencing, daily coaching conversations, and SMS notifications. Elyva is not a medical device, medical treatment, or substitute for professional medical advice, diagnosis, or treatment.
You must be at least 18 years old to use Elyva. By signing up, you represent that you are at least 18 years of age. The Service is currently available to users in the United States. You must provide a valid phone number to create an account.
You are responsible for maintaining the security of your account credentials. You agree to provide accurate information during registration and to update your information if it changes. You are responsible for all activity that occurs under your account. Notify us immediately at support@elyva.ai if you suspect unauthorized access to your account.
Elyva offers a subscription-based service. Pricing, trial periods, and billing cycles will be presented to you at the time of purchase. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access until then. Refund requests may be submitted to support@elyva.ai and will be reviewed on a case-by-case basis.
By signing up for Elyva, you consent to receive SMS messages related to your coaching journey, including daily check-in reminders and new intervention notifications. Message frequency varies based on your activity and coaching stage. Message and data rates may apply. You may opt out at any time by replying STOP to any SMS message from Elyva. For help, reply HELP or contact support@elyva.ai. Opting out of SMS does not cancel your subscription — you can continue using Elyva through the web app. Your mobile information will not be shared with third parties for promotional or marketing purposes.
Elyva is a behavioral coaching tool, not a medical service. The Service does not provide medical advice, diagnose conditions, prescribe treatments, or replace the care of qualified healthcare professionals. The coaching, insights, and interventions provided by Elyva are generated by artificial intelligence and are intended for informational and behavioral support purposes only. Always consult your physician or qualified healthcare provider before making changes to your diet, exercise, or health routine, especially if you have existing medical conditions, take medications, or are pregnant or nursing. If you experience a medical emergency, contact emergency services immediately. By using Elyva, you acknowledge that you use the Service at your own risk and that results vary from person to person.
Elyva's coaching responses, diagnostic insights, and intervention recommendations are generated by artificial intelligence. While designed to be personalized and evidence-informed, AI-generated content may occasionally be inaccurate, incomplete, or not applicable to your specific situation. Elyva continuously improves based on user interactions, but we do not guarantee specific outcomes, weight loss results, or behavioral changes. Use your own judgment when applying any guidance from the Service.
You agree to use Elyva for its intended purpose of personal behavioral coaching. You agree not to misuse the Service, attempt to reverse-engineer the underlying systems, share your account with others, use the Service for any unlawful purpose, or submit intentionally false or misleading information during your intake or check-ins. We reserve the right to suspend or terminate accounts that violate these terms.
All content, design, technology, and systems within Elyva — including the diagnostic architecture, intervention sequencing methodology, visual design, and branding — are the intellectual property of Elyva Inc. and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
Your use of Elyva is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
To the maximum extent permitted by law, Elyva Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to Elyva in the 12 months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
We may update these Terms and Conditions from time to time. When we make material changes, we will notify you through the Service or via SMS. Your continued use of Elyva after changes are posted constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.
You may terminate your account at any time by contacting support@elyva.ai. We may terminate or suspend your account if you violate these terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Data deletion following termination is handled in accordance with our Privacy Policy.
These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of California.
